Ripoff -collecting way too much money, and blaming it in the bankruptcy court

I am trying hard to refi out from under these crooks. I brought my payment history to the mortgage broker I am working with, neither one of us could figure it out. We had to make extra payments last year, a triple in Feb., 2 in July, and 2 in August. We did all that, and their own lawyer said we were caught up. Well, the story is like this-talked to Susan in Research, BK Dept. She said that all that money is concerning the BK, some type of pre-something payment. She said when she looks at that pre-something payment, we are ahead to May of 06, yet still 3 months behind in the actual house payment.

This money from the BK she said hadn't been paid on since 10 of 04, so if they were holding money at the Trustee level, that it could catch us up. (?) The mortgage broker tried hard to understand, he's pretty knowledgable about this stuff, but he is so confused.

Anyway, he asked if I still had my last appraisal I had done, cause his came in alittle lower, and I thought I did, so I began looking. What I found was a disbursal report I had to get for someone else, that shows in 8 of 04 those BK payments were still going to Litton (who had my loan before Ocwen, and believe it or not I had no problem with them), and at that time their was only $528 left to be paid.

So now I'm thinking-ok, number 1, Ocwen didn't even get my loan until almost the end of 04, and my payment history starts 1 of 05, where are they saying I owe all this money from in that short time? There shows only $528 being owed back in 8-04, so if all these triple and double pays are going to this pre-whatever, concerning the BK, where is it now? Why am I supposedly behind 3 house payments? I even got nasty with her, and she told the broker to have me call my lawyer, because she won't be talked to like that (poor thing-it's ok to steal people's money tho, right)?

Anyway, I am going to call the BK court on Monday, and get a disbursal report from 8-04 to the present, and make sure they have been paying Ocwen and not Litton-but even if not, there was only $528 owed that was behind-that's less than 1 mortgage payment-where are the other 6??? I should be at least 1 month ahead of my mortgage, not 3 short.

God knows these people aggravate me. I told my husband, before this is done, I will own this house!!!
