Filed a false affidavit, then sued in court. When asked to produce documentation to back up their Affidavit, they withdrew. It was an attempt to use the Massachusetts Legal system to bully me into a settlement

In Palisades filed suit here in Massachusetts claiming to be the "Assignee" of an old credit card account. While I knew there was a debt out there, it was over five years ago and past experience with debt collections has shown me that amounts are often times wrong, they bought it from someone who bought it from someone and each piles fees (without notice or legal standing) on.in my discovery motions, I asked for documented proof that they were the owner and the amount was true and accurate.
I had elected to represent myself. (If I could afford a lawyer, I would have just paid the debt.) I went to four pre-trial conference. Each time we informed the judge we wanted proof of ownership and their attorney said it would produced shortly. Finally, after a year, we got a motion to compel them to produce the documentation and they withdrew.
During this time they would pull things like calling the house demanding a settlement, even after they had been informed it was in court. They sent a letter saying I had put in a claim of "Identity Theft" and that they were suspending their claim. It was nothing more than an attempt to get me not to show up in court and default.
After extensive research on the web, here is what I have learned.
They will start a court action. For no other reason than to scare you into settling.
They do not own the debt, but they will produce an "Affiddavit" claiming to the "Assignee". This is a SCAM. It has no legal standing and if they produce it CHALLENGE the validity!
They will waste your time with pre-trial confenences. They will send letters saying they are dropping the case. DO NOT fail to appear in court. This time waste will also bring the amount of the debt up (They will claim legal fees) and if you don't fight, you would be forced to settle for even more money.
Once a legal defence is mounted they will drop the case. The worst part about all this is we went through a year of this and the original debt is still out there!
Log onto the Federal Trade Commission web site and complain. They have already been fined by the FTC MULTIPLE times! Give it back to them in spades!!
