Excessive overdraft charges

I believe the practices of Sky Bank are in conflict with the principles of good faith and fair dealing, and I am seeking assistance in a wrongful conduct act against my son, Thomas McEntire.

In April, my husband, Roger and I moved from our home in Pennsylvania to Las Vegas, NV to obtain employment. Before leaving for Las Vegas I had a conversation with Cathy Beatrice, in the Transfer, PA office, who led me to believe that it would not be necessary for me to close out our checking account with Sky Bank because I could continue to make deposits and withdrawals into the account using my debit card at any participating financial institution.

When arriving in Las Vegas I then realized it would not be possible for me to add funds to this account since there are no participating Sky Bank financial institutions in Las Vegas. As a result I carefully monitored my withdrawals. Without my knowledge charges were made against my debit card which overdrew the account $200.00 and accruing overdraft charges in excess of $400.00. Since I had not yet informed Sky Bank of my new address, and unfortunately the only mail that was not forwarded to me by the postal system was everything except my Sky Bank April statement, and the overdraft notices. I was not even aware that my account was overdrawn until Sky Bank deducted $557.00 from my son's account.

The reason for the deduction from Tom's account, unfortunately for Tom, was because my name was on his account when he opened it in 2002. I never made any withdrawals from the account, nor do I have a debit card. The following day of the $557.00 deduction from Tom's account, Tom went into the Transfer, PA branch and spoke with you about his situation and his thoughts that he should close out his checking account with Sky Bank. From the conversation with you, Tom trusted that when Sky Bank investigated the unauthorized charges the money would be returned to his account.

This did not happen, which left his checking account balance with 14 cents. At this point in time Tom's checking account was on hold and he was unable to make any withdrawals using his debit card due to insufficient funds. Tom would periodically attempt to use the debit card to find out if the bank had reimbursed his account. Several attempts denied him money due to insufficient funds. Until one point the bank authorized a $5.00 purchase at Shell Oil, which conveniently overdrew the account.

This then allowed the bank to accrue overdraft charges in excess of $90.00. And, now your VP of Collections in New Castle, PA has informed me that if Tom does not pay the overdraft charges of more than $100.00 he is being referred to Chex System, and he will not be able to ever again open a checking account in the United States. When asked how I could dispute this matter he gave me a telephone number to call.in an unsuccessful attempt to make contact with this company, I called the collections officer to ask for an address. He then informed me that he did not have that information and I would now need to contact a branch manager for such matters.
