Ripoff Wrong credit reporting

Our mortgage was sold 2 years ago to EMC. We ended up in default but were able to bring completely current and avoided foreclosure. We have, in the 2 years since, never missed nor had a late payment. We recently applied to another mortgage company for a refinance to get out from under EMC's horrible thumb, and were turned down due to a foreclosure by EMC showing up on our credit report. Well, that's funny, because we were NEVER foreclosed on. I followed their instructions to have this removed from our credit and 2 months later, IT'S STILL THERE!

They keep telling us this research takes time. When I talked to one of their supervisors (after about 45 calls to rude, inconsiderate employees) he admitted it was their error. The company I am trying to refinance with told me that even if EMC would just fax him a letter saying it was an error, they (the new mortgage company) would fix the error with the credit reporting agencies. I relayed that information and was told by EMC that it would still take at least 60 days for the research to be done. What, to research an error that they already told me was THEIRS?! Here we sit, with mortgage rates going up, being held hostage by this rip-off, joke of a company. Anyone have any suggestions?
