Defective karaoke CD refused, only same-title exchange offered

My 7 year old daughter bought 3 karaoke CDs with her birthday money, 2 Hanna Montana CDs and Tylar Swift, two cd worked great the Hanna Montana 3 is defective, it does not bring up the graphics on the screen of her karaoke machine, we tried to return it,
they told us that once its open you can not get a refund, you have to trade it for the same one. But the stores don't have them any more, so I asked them if the would get it again they said theres no garanty they will, and if we dont your stuck with it, how can you sell a product and not back it, if its defective
, we would like the store to refund the money for this cd, if not i guess a big retailer will screw a 7 year old out of her money
