Not honoring warranty for 2007 Can-Am 500 Max XT which burnt up while up in operation

Sports

My 2007 Can Am Max XT 500 burnt up while in use on September 26. The machine was brought in to an authorized dealer 2 weeks earlier for a problem of over heating. The dealer said the outside of the radiator was dirty. The dealer cleaned the outside of the radiator and said the machine was ready for use. The dealer did not notice that part of the seat had melted off because of the over heating. 2 weeks later while in use grouse hunting on a forest trail and going about 10 to 15 miles per hour, I noticed that my legs were getting hot from the heat of the engine. There was no hot engine light that came on. I looked down and saw smoke and fire coming from the left side of the machine. At first I thought the seat was on fire. I removed the seat and confirmed that the engine was in fact on fire. The ATV burnt up quickly and was a total loss.
