Owen's Marine - Sold a boat thru Ebay they did not have title to

In short, we purchased a boat through Ebay from this dealership located in New Hampshire on August 16. We paid a deposit through Paypal and then drove to New Hampshire to pick up and pay for the boat.

When we arrived they did not have the boat. We sat at the dealership waiting for an answer for 4 hours. Supposedly the salesman that sold it to us, Jim, had quit recently and gone to work for another dealership after working at this one for a number of years, even though we had spoke with the salesman just two days before arriving.

The boat was supposedly one that a customer of theirs traded-in on a new one, but the purchaser supposedly took the boat back home to remove personal items and never brought it back, and did not complete the deal on the new one. We did receive our deposit back (big deal!), but we spent a lot of money (approx. $3,000), and time away from work, going up there to retrieve it, being misled during cellphone calls all the way up there.in fact, we spoke with the salesman the day before we were to arrive and that was when he informed us that the "previous" owner had taken the boat home to clean it out and the salesman asked if we could wait another day to come to pick up the boat. What it boils down to is this: the dealership put up for sale a boat that they never had title to.in my book, that's fraud!

In addition, the owner, Randy Owens was very non-shalant about the whole thing... Like it was no big deal and acted like he wondered what we were waiting around for. Well, Mr. Owens, an apology maybe?!?!?! An offer to help offset some of our expenses would have been nice!!! But NO, he couldn't even offer us a drink of water after waiting around for 4 hours with no answer. What a jerk!!! I wouldn't buy a boat from this dealership if he had the last boat in the world.

We have filed a Consumer Complaint Form with both the New Hampshire Attorney General's office and the Federal Trade Commisssion. We also filed complaints with Ebay and Square Trade, to no avail since we did receive our deposit back. We gave up until my husband recently took an attorney fishing and he said that he thought we had a case, but that his firm did not do that type of law. I have kept a fairly extensive set of records and receipts. I don't know whether I should contact a law firm here in Florida or if I should use someone in New Hampshire, in case this would be considered a federal offense. I have sent emails to several law firms, so I should know in a day or so.

Be prepared, Mr. Owens... We haven't given up yet.
