Took my money never sent me my airsoft gun

On September ninth 2008 i purchased an airsoft gun from hobbytron the next day they took the money out my account. It said it would ship in 3-5 business days. 2 days later it went on back order and it is now october 2 and it was still not sent yet.
I emaled them 4 times every time they say we are still waiting for the item. Never ever use hobbytron it is the worst company ever. The company needs to be shutdown immeadiately.
How long do i have to wait until i can sue them?
