The membership was canceled, but card was never refunded

I'd initially got a merchant account with InstantCheckmate, but mentioned it with many buddies; discovered that their methods were deceptive. I quickly approached them-and ended my account, and requested to get a return. I had been informed that my account could be ended, and my charge card returned. No such luck. The account was ended, but card was never returned. After repeated calls for them, they're today stating that they can stop my account just after 3 months.
