Unethical Contract Practices

I dont know how ADT does business but we were never
informed that we were signing a 3-year contract with Brinks. We would never
have done that as our jobs were not exactly permanent. It may be in the small
print but we never were told about it. We have now both lost our jobs in MO and
have temporarily re-located to another state to look for work. We cannot afford
to pay either the penalty or our monthly fee any more. I told the Brinks people
to come take their equipment, but they didnt want to do that. Now you want a cancellation fee that is higher than all we would owe if we paid for the whole (unethical) '3 year contract' you tricked us into signing.
Go ahead, take legal action. This action would cost you many times the amount you think you are owed due to
the unethical contract we unknowingly signed. But much more than that, I will
unleash a PR campaign both in local and Internet media about your unethical and
unprofessional practices. It should make you proud to know you are basically
terrorizing two poor unemployed peopleIm sure that story will have strong
legs in our current climate.
I worked as a consumer activist and I know
every legal trick in the book to expose companies that treat their customers
like dirt when they are down and out. You ought to be ashamed of your behavior,
basically tricking people into long-term contracts, then taking advantage of
them when their luck and prospects are down.
If this situation is not corrected immediately (contract
cancelled at no cost to me), I will be taking the following actions:
1) I will
be contacting all my local papers, whose editors all know me, and get them to
publish a human interest story about how the large corporation was so
unethical and ripped off the small consumer.in these days of hatred against
large corporations, Im sure the story will go over very well.
2) I will
get a group of his friends to picket outside area Brinks/ADT offices with signs
saying, ADT ripped off my family.
3) I have
contacted a lawyer who will be more than happy to help me file a case against
you in small claims court and also file a civil case against you.
4) I will
be submitting a claim against you with the Missouri Attorney Generals Consumer
Complaint Public Inquiry Unit.
5) I am filing a claim against both the local
and national Brinks/ADT with the Better Business Bureau.
6) I will be sending numerous letters to your
Corporate headquarters, informing your top executives of my plans listed above.
7) My wife and I will take lie-detector tests
to confirm that we were never informed about there being a 3 years contract and
a penalty for early cancellation.
This is no way to
treat a customer and I guess it shows how your current management wants
customers treated, in an unprofessional and unethical manner.
Filed the
following complaint with the Better Business Bureau and will now send it to the
Missouri Attorney Generals Consumer Complaint Public Inquiry Unit and the California Attorney Generals Consumer
Fraud Office. You are not monitoring our systemyou are charging for services
not providedthis is illegal. I will be posting a transcript of my conversation
with your representativewhere he said, 'ADT is NOT responsible for making sure
you understand what is in the contract you signed or telling you all it's
provisions.' That should get you many new customers&good luck in court.
This involves our house in Missouri—not sure why it is
going to Florida. We were never told about a 3 year contract that we were
signing and we never would have signed such a contract as our jobs were not
certain to last that long—they didn't—so we became unemployed after about 2
years—and we moved over a year ago to California to seek employment. I have
tried numerous times to contact ADT—with no luck until about a week ago when
they finally answered my e-mail—and told me—and this is an exact quote—'ADT
is NOT responsible for making sure you understand what is in the contract you
signed or telling you all it's provisions.' I am handicapped and unemployed and
cannot afford to pay either the monthly fee for the rest of our contract or pay
ADT's unethical cancellation fee (which is MORE than the total monthly fees we
would pay!). We are not receiving any service from them now and haven't in over
a year—yet they demand we pay for service they re not providing (and we don't
need as we moved out over a year ago.) We signed a contract that we would never
have signed if the truth was told—and now they say they any responsible for telling
the truth about their contracts. I have no money to give them and they have
zero understanding of their unethical behavior or how large companies that
'screw' the small consumer are viewed these days. I want to be left alone—we
have paid them enough and especially don't pay for zero service—they said the
alarm system had go be tested every 2 weeks or they would notify us to start
doing that—they haven't noticed in well over a year that the system isn't
being tested—so much for them paying attention to the security systems they
sell with unethical and unprofessional practices.
