Some child custody evaluators are incompetent, some consistently slant their recommendation toward Mothers or Fathers, some are sloppy and make mistakes; however, Dr. Kerner is actually engaging in criminal behavior in some cases. His MO is that he aligns himself with the more powerful attorney, rather than be neutral. If the opposing partes' attorneys are somewhat equal in community status, he then aligns himself with the Father. It is never about the Best Interest standard. It is pretty common for Dr. Kerner to give Fathers jailed for Domestic Violence full custody of the kids, even if the Mother has a perfectly clean record. He simply avoids doing a 3044 analysis. He will fabricate quotes. He will hide the actual psychological testing results and report the mentally ill parent as being healthy, and the healthy parent as being mentally ill. You won't find out what the laboratory report to Dr. Kerner actually said until you prepare for trial. Attorneys say he used to be good many years ago. But there are so many cases he is fighting right now, where he is defending a poor work product and sometimes being accused of criminal behavior, that many attorneys say they will never use him again.
