Jay Rasmussen did not live up to their written guarantee. He is the person who did my taxes

Liberty Tax Service (franchised) prepared my federal income tax for the year 2009.
I was notified by the IRS that I owed them $1710.00 for 2009
They (Jay Rasmussen) put an item in the wrong place. He admitted to it.
He stated that they would pay me the interest, penalities and what I paid for their service for 2009.
I have been down to their offices every Monday as that is the only day they are opened since it is not tax season.
Mr. Rasmussen has not responed to numerous phone calls or e-mails.
I have set up a payment plan with the IRS, but I need the monies promised to me so I can pay them off sooner.
I am retired and on a limited income.
I need your help as I do not know what to do next.
