Charged my credit card for items not sent and now said they are out of business

I placed an on-line order on Oct. 18. They charged my credit card on Oct. 19 for $94.95. I only received 3 out of the 7 items ordered. The total should have come to $72.97. When I called the company I was told that they went out of business. Their web site is still on-line and offering deals. A male named Scott answered the phone to the business number listed on the still existing web site. If they are out of business their web site should be taken off line.
