Wrongful Act

I called S&J Storage on 04/20/10 at 11:50 A.M. To check if my vehicle and my wife’s vehicle were towed to there Vehicle Storage Facility. I talked to Melissa and she stated that both vehicles were there and the fee for each vehicle was $236.80. I asked what I needed to get our vehicles out. She informed me that I needed my title/registration, identification and my insurance. I informed her that one of the vehicle’s wasn’t running so I would have to move it and have it towed. Melissa assured me that once I pay and show proof of ownership that it wouldn't be a problem.

My wife and I arrived to S&J Storage around 12:30 and were greeted by Melissa. She asked my wife for her identification and made a copy of it. She then asked for a second form of ID and my wife told Melissa she did have it but it was in the vehicle they had in storage. My wife asked if she can inspect the vehicle and get some personal items. Melissa said that we were unable to check or inspect the vehicles and that we had to pay first. My wife told Melissa that we had a right to inspect the vehicle and Melissa said No that if she wanted she would hold the vehicle for three days. My wife handed Melissa her bank card and then she said there would be a $10.00 fee to use the card. We declined the fee and went to the bank to take the money out. When we came back to give Melissa $240 in twenty dollars bills. She tells us she has no change and that we would have to go next door to get change. So I go next door to get change. On my way back we notice another customer coming in to pay and Melissa was able to give them change. I gave Melissa the exact change and she gave us all the paperwork we needed to sign. Melissa went outside to open the gate so my wife can get in the vehicle and get another form of ID. At that point we were able to inspect the vehicle, and get another proof of ownership. We gave Melissa both registration and proof of insurance and she only made a copy of the registration form. I told Melissa that we will come back to pick up my vehicle. I informed Melissa again that my vehicle isn’t in a running condition and that we would have to moved it from the lot. Melissa assures me that once the fee is paid and I show proof of ownership that it wouldn't be a problem. I told Melissa that I had my insurance but that it had expired this year. She said that she wouldn’t be able to accept it as proof of ownership. That I must bring my ID along with the title of my vehicle so she can release it.

We got back to S&J Storage around 3:45P.M. I gave Melissa my ID along with my title and she then tells me that she wouldn’t release my vehicle because it’s not running and that it had to be driven out of the lot. Melissa refused to release my vehicle even though I complied with all the required information. So I called Humble Police for assistance. Before the police arrived to the scene Melissa came outside to put a big trash can in front of the business rules and complaint information. Officer JV Brown arrived to the scene at 4:10P.M. Officer Brown got both parties information. After going back in forth with the Vehicle Storage Facilities Rules. I had to release my vehicle to a mechanic that was adjacent to the vsf location. An employee from S&J Storage was instructed to take my vehicle out of the lot with a forklift. When the employee was attempting to move my vehicle out of their lot he managed to make several gashes on my front bumper. Several people witness his actions including the officer and myself. Police officer said he was unable to do anything about it because it was a civil matter. Also both vehicle’s were taken out in less than 24 hours and we were still charged a notification fee.
