I called the recovery company that damaged the transmission. Spoke with owner. Once he knew who I was he proceeded to tell me his side of the story. He was not present when everything occurred with the damage to the vehicle. He is going on hearsay and what his family member who works for him said. He did not appear aware of the damage that was done to my vehicle, the expedition and to mines and my neighbors fence. He was just going by what was told to him. There were five cops at the scene and none of the cops informed me that they saw any damage being done to the tow truck. All of my neighbors that were home and watching saw the towman drag my Ford Taurus on the street while driving off with an unsecured Expedition and the passenger side door open.
Owner seems to think we owe for damages, but none were done to his vehicle while three items were damaged by the towman and I was a witness to all of it. Owner also did not deny that tampering was done to the truck to disable it. He made the comment that the transmission cable was taken off and there is a clip attached to it. I stated that the clip had been broken and we are not responsible for any repairs that need to be done.
Owner also says he owns a body shop so if we did do damage, which we did not, to his vehicle, he could repair ii with no cost to him. We do not own a transmission shop.
He is sticking up for his nephew due to family links and feels his nephew would not lie to him but he would if he did something wrong. Owner is denying any responsibility to what his nephew on behalf of his company did and we just want the vehicle we have to pay for to be properly fixed and in running condition for our family use.
I cannot afford a lawyer if I cannot afford a repair and barely the truck payment. As a customer, we have rights to obtain information to file suit. I advised owner of this as he proceeded to say Westlake should not give out information as far as addresses. This leads into why we got the runaround from Westlake for the last couple of months on who the tow company was. It was not until I notified the CFO and stated I was filing a court case that the tow companys information was released.

Making a clean, quiet repo isn't just a safety matter, it's a legal necessity. State laws require that all repos happen without a "breach of the peace." That means that if the owner notices the repo in progress and comes out of the house yelling and screaming, the repo agent can't legally repossess the car but as in our case, they will continue to do so thinking you do not not know the law.

The truck has been damaged by the negligence of the recovery company that Westlake hired to come pick up the vehicle in late July. When I mean damaged, a costly repair with the transmission. We have evidence of the repossession man sneaking to our property in the early morning and sabotaging the vehicle so it would not move. The brilliant towman decided to unhook the transmission cable and broke off a piece in the process. I know there are underlying laws that the tow company should not have acted so aggressively. They are supposed to peacefully resolve the issue, not tear everything up in the process.
