Failure to deliver as promised

Ellen Whelan called our office with an offer to sell us leads at a rate of $35 per. I turned it over to our CEO. We agreed with Skyy Radio for a test of 12k with $7410 paid up front. This comes to about 342 leads (@35). The test started on 4-6. Ellen stated that they expected all the leads to come in during a two week period, but if not fully delivered, they would keep ads going until fulfilled.

We ended up receiving a total of 25 leads from 4-6 to 4-10. After that we got 1 call on 4-11,1 call on 4-12 and 1 call on 4-12, none of which turned out to be leads. We've received nothing since then.

I've left several messages for Jay Bailey, the President, Ellen Whelan and the general mailbox to no avail. I've also sent certified letter which they have not signed for. Principals in their company are: Jay Bailey President, Stephen Eisenberg, CEO, Stephen Kirkpatrick VP and Treasurer Edward Sperber.
