Owner LIES to Keep Employees From Collecting Unemployment!

The crook/owner of Mighty Maid Cleaning Service located in the Outer Banks, NC, is keeping me from collecting Employment Insurance. He is a LIER!!! I have been working beyond full time since early spring through September. The hours were starting to fade in mid October. I was asked to clean only two condos the week of Oct 19. I told JoAnn, lady working the front office, that "I guess it's that time of year that things are going to start slowing down" she agreed. I proceeded to say that "I guess it's time to start applying for unemployment"... To supplement!!! She heard the word "UNEMPLOYMENT" and went nuts. I have a right to supplement my income with employment insurance. She told me that I will never receive unemployment due to the fact that "I REFUSED TO WORK"!!! What???!!! I didn't refuse to work, I just want to supplement my income and keep working. I went form $8/900 per week down to two condos for $30 each!!! That is definitely a huge cut. The law states that you are entitled to collect if your income/hours have been reduced by 2/3. She told me to pick up my last paycheck... I was confused as to why I had to pick up my last paycheck if I was still able to work. I argued back. She proceeded to bully me and told me that in order to pick up my last paycheck, I had to sign a "form". I asked what kind of form, and that particular blackmailing tactic is very illegal and CANNOT hold my paycheck! She hung up. I called back. She hung up... So, I called the owner, Wayne Carter... Who is a BIG LIER!!! I found out that Wayne isn't even his name!!! It's Rudolph!!! He told me the same thing... To sign that form before I am allowed to pick up my last paycheck. I refused. He refused to give me my paycheck. I called the State Labor Board on 10/23/08 to report him. They read the Wage & Hour Act... Statue 95-25.6. Wage payment. I called him back and read it to him. He laughed. I told him that it wasn't funny and that he was breaking the law. He hung up. I filed for employment insurance that week and it's been a living nightmare! It went all the way to adjudication, 8 weeks later. I was disqualified for receiving benefits due to the fact that I "left work without good cause attributed to the owner." I NEVER walked out... I was told to pick up my last paycheck after I sign a form!!! I was let go!!! I am in the middle of appealing it. It is now after Christmas, and I am owed over $3k! I worked my butt off this summer working 7 days a week and deserve my money!!! I am married with 3 girls. I recently got my car repossessed, thanks to this crook. My bills are way behind. This was a terrible Christmas to say the least. All I wanted was to keep working and collecting unemployment to help out with the slow weeks and wait it out until spring time, when it starts getting busy. There is NO work in my area. We had to spend several days without a phone and electricity... Until my mom helped out. I'm not the only one he is doing this to. He is cheap and doesn't want to pay higher unemployment taxes. He makes all of his employees sign that illegal form. I feel sorry for them for not knowing the law. If you "resign", you can't collect unemployment. He is very clever. I hope the state will listen to me and not believe his lies... And screw me and my family. He doesn't even do a criminal background check on his employees!!! He is too cheap to pay for it! Several years ago, I lost my Driver's license. He asked to see my ID when I filled out the application. He didn't even care and still sent me out in the field! These houses are vacation homes that rent weekly and are worth several million dollars. He doesn't care... Just clean the house and he makes all of the money. He is very smooth and talks a mile-a-minute and jumps around to confuse you... He never really gives you a straight answer.
