SCAM / Ripoff - The Marcel Group A.K. A Marcel Inc, A.K.A. Orleans Ventures Ltd. Tilly, events, wedding, winery, banquet

I am the previous owner of UnDiscovered Time - The Winery. Tilly's Events was planning on moving into my previous location at 18321 W. Lake Houston Parkway Ste 260,77346. They attempted to use UnDiscovered Time in their advertisement using my exact logo and name. Even though UnDiscovered Time - The Winery is not in operation, the Corporation still exists. We immediately sent a cease and desist letter in which we got a bunch of mumbo jumbo and how "God" had sent them to this location and we need to just forgive and forget. Being an engineer in the oil field business for more than 15 years, I don't go for that type of lingo. I wrote them back stating that they had violated my copyright rights and trademark infringement. I then wrote the State of Texas to report this infringment. Tilly's Events also tried to "piggyback" my winery permit stating that they bought the business from me and they had the right to use it to sell alcohol. I immediately wrote the TABC and the TTB to report this violation as I have never given any permission to use my permit nor had I sold the company and that UnDiscovered Time LLC is still a legal entity.

I also found out that Vernon Veldekens, owner of Orleans Square was working with this company. The equipment that I had left behind belonged to the creditors in which they told me to leave it there and they would pick it up. Tilly's Events stated that Vernon Veldekens of Orleans Ventures (a.K.A. The Marcel Group, a.K. A Marcel Inc.) sold them the equipment. The creditors then contacted Vernon as it was not his equipment to sell. I later received a letter from Jeff Kaiser of Kaiser & Conrad - Attorney at Law stating that I needed to stay out of this as my interest from the bankruptcy was turned over to the State of Texas. I replied that they should find out all the facts before they point fingers. I also ensued a Cease and Desist for the use of UnDiscovered Time for the same reasons above. I have attached information from the State of Texas as contact information and is deemed public.

I would also like to add to the report that Marcel Inc (a.K.A. The Marcel Group, a.K.A. Orleans Ventured Ltd, a.K. A Vernon Marcel Veldekens) should also be investigated by the City of Houston and the State of Texas for contract infringement. Our company closed due to incomplete construction as per our contract, blue prints, and written agreements. Their delay in building and delay in submitting paperwork to the TABC resulted directly to lost sales, improper climate control of the wine making room, and lost customer base from wrongful advertisement. It has been filed that Vernon Veldekens owes UnDiscovered Time LLC $300,000 for lost sales, wrongful advertisement and uncompleted and incorrect construction. Vernon also agreed, in person, on video and audio equipment to delay our first rent to January 1 to help reconcile the delay. On September 1, he demaned payment as he didn't "recall" ever stating the push back of rent. Karen Williams and Jan Cantrell where also involved in this deception. Vernon decided to ignor our attorney resulting in a long delay in legal action. As we were already out the $300,000 we were unable to persue further legal action. Any person or entity that deals with Marcel et. Al should be vary cautious and never take Vernon for his word. It is this authors opinion that he, nor any other employee can not be trusted any further than Tilly's Events. The law firm Kaiser and Conrad was reported to the State of Texas bar association for fraudulent legal practice. I have had no report form the state bar to any investigation.

I would also like to add that Tilly's Events is in way associated with UnDiscovered Time LLC or its subsidiaries. UnDiscovered Time, its name, logo and all materials associated is property of UnDiscovered Time LLC, a legal entity in the State of Texas. Any unauthorized use of UnDiscovered Time is unlawful and legal action shall be instigated immediately.

Statement from the State of Texas:

Our records also show no record of a Texas corporation, limited liability company, limited partnership, or limited liability partnership or registered foreign entity with the legal name of Tilly's Events and More or Tilly's Creole Undiscovered Times Bistro. Please note that it is not required that a person organize his/her business as a corporation, limited liability company, or limited partnership, or other organized entity. However, a person that has organized his/her business as a corporation, limited liability company, or limited partnership in a state other than Texas and that has a place of business in Texas would be required to register with the Secretary of State as a foreign entity.

However, I would also note that a search of our records does show that on March 28, a certificate of formation was filed for the formation of a Texas limited liability company by the name of Tilly Events, LLC (File number 800957394). The initial registered agent of the limited liability company was Harrison Johnson, and the initial registered office address for the company was given as 521 N. Sam Houston Parkway E., Suite 647, Houston, Texas 77060. The initial manager named in the certificate of formation was Matilda Johnson. The address of the initial manager is shown as 521 N. Sam Houston Parkway E Suite 647 Houston, Texas 77060. The entity's current status is, involuntarily terminated. The entity was involuntarily terminated by action of the Secretary of State due to the failure of the entity to pay a fee in connection with the filing of its certificate of formation. The entity was involuntarily terminated effective May 20.
