Harbor Freight violation of contract

My company (The Wood Barn Inc.) purchased a US General model# 55261 for 675.00 plus 129.99 2 year extended service plan, from Harbor Frieght on Aug, 28 of 2007. About May our compressor stopped working. We were told to bring the compressor to J&S Tool repair, in honor of our contract. We did and about a month went by before my phone calls on its status were finally returned.

AMT Service Corp, contacted me and explained that the compressor cost to fix was higher than the value of the item itself. I was told I would be sent a buy out letter via fax.

I recieved the letter, and I was told that we would recieve 609.19 for the compressor.in the contract it clearly stated that no hidden costs would effect us. Explained to me over the phone however, I was told that a 6% depreciation value took its value down. I told them instead I would rather have a working compressor of equal or higher value to the one we purchased with the remainder of our warranty in tact. I was refused.
AMT and Harbor Frieght violated our contract. We do not want another air compressor if it does not include our warranty. If we are to be bought out of the contract then we feel we deserve the 850.55 that we paid at the date of purchase.

We have already purchased a Ingersoll Rand compressor as our company has been with out a compressor for two months. We will accept the 609.12 as it is clear that Harbor Frieght will not honor the contract they made. We feel they should repay us the additional 241.36.
