Significantly overestimated volume of goods shipped and did not meet delivery committment

I was provided a non-binding estimate for $7335.01 for a volume of 2445 cf. I was not provided with any information about my rights and responsibilites under Federal law. After the truck was loaded I was told that the volume of my good was 4200 cf. Upon comparing the bill of lading with the original inventory from the estimate I found that the number of items had only increased by 10%. (I later determined the additional items could not possibly have exceeded 300 cf.) I then realized that the claimed volume equated to an average of 10.5 cf per item shipped! That was clearly impossible.

I presumed the driver was trying to rip me off, so I contacted Expedient Relocation. I spoke with a customer service agent who identified herself as Janet. I explained to her why I thought I was being ripped off. She promised to check into it and get back to me that afternoon. That was 2 weeks ago. I never heard from her again.

After leaving several messages for Janet and sending emails describing my concerns, I was contacted by an individual who identified himself as Don. I explained to Don why I thought I was being ripped off. Don promised to check into it and get back to me right away. Don provided me with his cell number, but never answers when I call. He does not have a recorded greeting on the phone, so I can't help but wonder whether his name is really Don. I have taken to contacting Nicky, my sales rep, after Don has failed to return my call for several hours. Once I do that, Don returns my call. Each time he tries to convince me that I should agree to pay an amount lower than the driver wanted, but still significantly more than the $7335 quote I received.

I was told by Expedient Relocation that they were loading the truck on three separate occasions. The shipment was supposed to arrive on April 15. After April 15 I was told the goods would be delivered April 22 or 23. I was told the driver has been instructed not to unload the truck unless I pay a total of $12,250. I was also told the driver would contact me 72 hours in advance. As of 6 PM on April 22 I have not been contacted by the driver. I have sent email and left messages for Don, but have not received a reply.

I am moving a family of 6 that includes a 20 month old and a 3 year old. This situation has caused extreme duress for my family, especially my wife. We ended up staying 2 extra nights at the Residence Inn. We could no longer afford that, so we were forced to go out and purchase a refrigerator, bedding, air mattresses, and other items. We have been sleeping on air mattresses since 4/17 and living out of suitcases since 3/29. My wife got so upset about the situation that she threw her new cell phone. It is now broken beyond repair.
