Unwarrented CASDI tax withholding

The language in this report gets a bit technical, but if you've ever worked for a Quantum or Innovage company, please read this report to the end. You may be entitled to money withheld from the company.

During part of the year for I lived and worked in Colorado for Endeavor Marketing under their Denver, Colorado office. When I received my W-2 from this company, they listed their address as California, their state as
California, and paid my state income tax to California. Furthermore, my
W-2 box 14 lists a CASDI withholding for $37.32.

In the process of filling out my Long Form 540NR to get a refund of the California state income tax withheld from my pay, my calculated excess SDI on line 46 of Long Form 540NR totaled $0.

I never lived or worked in California, and expected that I would owe no SDI to the state of California and would be entitled to a refund of the CASDI withheld from my paycheck.

I contacted the CA FTB (ca. Taxhelp@ftb.ca. Gov) and, after a detailed explanation of how and why SDI tax is collected, they concluded with this:

"If you are not a California resident, and the job was not in California, and you only had one employer who deducted SDI, then the employer is responsible for refunding the SDI withheld."

Upon contacting Endeavor Marketing, I was told I would have to contact the Canadian company Herb Joy (this may be their payroll company?) to receive my refund. I left several messages with this company and received no response.

I am owed $37.32 from an overwithholding of a CASDI tax. I have reason to believe this particular problem superscedes the manager of this particular office, or any individual office operating under the Quatum/Innovage umbrella. I have wondered if this problem is happening throughout the Quantum and Innovage marketing companies. Please check your W-2's or paystubs if you're not a CA resident and locate your CASDI withholding. If money has been withheld, you are entitled to a refund from your employer. As I never received this refund, I am open to contacts from legal firms and the media to investigate this matter further. Thank you.
