I was charged on my Australian credit card for flowers which were never delivered

On about Sept. 10, from Garden Valley, Idaho, USA, I commenced a transaction with an internet floral company called Floral Originals, located in Beverly Hills, CA. I had wanted to send some flowers to my son and his wife in Neversink, NY, USA, using my credit card. On the 12th, I phoned my son and told him to be on the lookout for a delivery; he said the bouquet had not yet arrived but that he would be delighted when it did. A week later the flowers had still not been delivered. Meantime, I began phoning Floral Originals and on three occasions was told that someone would call back about the order.

Nobody ever did phone, so I contacted the Copmmonwealth Bank in Australia through their overseas phone number and was told that a charge had not come in for the flowers; at this point I stopped doing anything about the matter, assuming that the transaction had been voided.

To go back a bit. I was initially concerned about this order as all records of contacting Floral Originals had been removed from my computer. The receipt and any e-mails from the company were gone and are still missing. However, the company itself appears to have a record of my name and e-mail address as it popped up on their site today.

When we received our visa statement this afternoon a $70.31 charge was included from Floral Originals; I have contacted them by e-mail with my complaint and am waiting to hear back about the matter. I doubt that they will reply, however.

I am not sure whether I have been a victim of fraud or whether the florist's failure to deliver the product is simply an oversight.in any case and at the very least their advertising is deceptive as they promise free delivery and one day service, neither of which are true.
