Attempting to Mis-Classify Employees as Independent Contractors Ripoff

He posted flyers around town asking for a clean-up person between the hours of 8-10pm.
Called him at 714-293-1740

He said it could be anywhere from 1 hour to 4 hours, but was very specific in stating the hour to start.
Asked about wage, he reported 20 dollars a night.

He then said it would be at a 1099 status (Independent Contractor), but speaking to him for 5 minutes had already proven otherwise, thereby violating Common Rules Law established by the IRS. The first point is him controlling my hours of operation, second being that he said i would not have to supply my own materials.

After calling him out on it, he hung up on me.

I would advise you to boycott this business. Its becoming more and more common that business in the orange county area are attempting this misclassification to exploit the worker and avoid filing taxes.
