Ripoff Huge cancellation fees—use criminal leasing company

After looking at the recent rebuttal from Dan Christopher, who claims to be the CEO of Card Payment Solutions, I must respond by saying any company that doesn't stand behind the claims of its salesmen ans who uses Northern Leasing Systems as a leasing arm is not an ethical operation. Please do a search on this site for Northern Leasing to read all the horror stories from small business owners and the information about the recent class action lawsuit against them. A little over two years ago a salesman from Card Payment Solutions, Matthew Shaddox, aproached my wife who owned and operated a small retail business in Sacramento offering to reduce the costs of our credit card processing. Seeing that the agreement was for three years and knowing that the business was losing money she asked the salesman—in the presence of others—whether there was any penalty for early termination of the agreement. And she was told, "No."

So she agreed, and signed the agreement which was two and a half pages of extremely tiny print. He then pulled out the equipment lease—another three pages of extremely fine print, proceded to fill out the front page and then had my wife sign it. (This equipment lease was for Northern Leasing, was a non-cancellable four-year lease which in the tiny print gave Northern Leasing the right to sue her in New York State!) The Card Payment Solutions salesman did not disclose a word of this—and in fact did not even leave her with a copy of the Northern Leaseing Systems contract.

Three months later we had to close the business down. Whereupon I called Card Payment Solutions to cancel their service and was told to just send in a letter requesting cancellation—which I did. Then six weeks later Card Payment Solutions took $1452.53 out of our business checking account as a cancellation fee! After several phone calls to matthew Shaddox and a Mr. Zack Allen (one of the rudest people you would ever want to deal with on the phone!) in their Santa Barbara office, we were offered a $1000 refund if we would fax them a statement that we had no further claims against the company—which I refused to do.

I did finally get a $1000 refund without signing such a statement, and I did file a complaint with The Santa Barbara BBB claiming false representation on the part of the Card Payment Solution salesman. CPS, however, refused to refund the balance of the cancellation fee.

Then, of course, we had to deal with Northern Leasing Systems, After months of harrasing phone calls and threats to take us to court in New York and file a lein on our house and actually having my wife served a summons, they managed to extort nearly $2000 out of her to get them to drop the case. (This for a piece of equipment which had a retail value of about $500!)

So I'm very glad to hear from Mr. Dan Christopher that Card Payment Solutions is such an upstanding company.
