Fraudulent Services and Billing Practices

I received a collection notification from RMCB, dated 2 August stating that I owed $99.80 pursuant to services rendered by their client, Joan Marie. I wrote the following letter to the collection agency.

1. This letter is to inform you that the charges listed are in formal dispute and that no money will be paid until this dispute is settled.

2. Per the contract with Joan Marie—a copy of which is included—I have the right to break the contract, request a FULL REFUND of my money, and halt all services given either of two conditions. To quote the company's contract, "I have only to jot you a note to be reimbursed within 30 days and without discussion." These conditions are as follows:

A. ALL of her "psychic predictions" did not come true by 7 September or
b. I was unsatisfied "at any time for any reason."

3. I have attempted, pursuant to item 2b above, both in writing and by telephone, to contact Joan Marie (the company) directly to halt these services and obtain the refund of $19.95 (total payment of $24.95 less $5.00 shipping and handling). My letter was dated 12 December and telephone records indicate calls were placed on 6 and 7 July. The letter remains unanswered, and calls to the company were futile.

4. Research regarding "Joan Marie" indicates that this company has a long series of unsettled claims against it based upon fraudulent billing practices, misrepresentation of services, and unanswered complaints. Furthermore, the company is in bad standing with the Better Business Bureau of Delaware. The credentials of "Joan Marie, " if such a person exists, are highly suspicious. The "Keystone Guild of Astrologers, " to which she is supposed to belong, does not exist within the professional network of psychics and astrologers; and the American Federation of Astrologers lists only one certified member in Delaware—not Joan Marie. The call letters WMVB, unique to each FCC-listed broadcast station, do not belong to 97.3 FM, and there is no record of any TV appearances on CNBC labeled "Astrologically Yours with Joan Marie."

5Additional research indicates that Joan Marie (the company) is a fraud, possibly trading on the reputable names of two well-known psychics/mediums, and concurrently operating under, or connected with, at least the following names: Frank Don, Frank Andrews, Pascale Zoe, Rose Hart, and Wendy Carol. These operations have been noted in at least the United States, the United Kingdom, Canada, and Germany.

5. Copies of this letter have been sent to the Attorneys General of Ohio, New York, and Delaware along with requests for assistance. Additionally, reports have been filed on my behalf with both the Better Business Bureau of Delaware and New York, and Usa Consumer Complaints.com via the internet.

6. My credit score is and has been impeccable for many years. I fully expect it to remain so. Should any negative information be filed with any credit bureau based upon this transaction, I will most certainly take legal action.

7. I would definitely appreciate your assistance in resolving this matter. Please address any questions to me at the address given above."

I am aware that many others have lodged similar complaints, both against Joan Marie and against RMCB I would be greatly interested in any class action law suits that may result from all of these complaints. I understand that many of these "psychic" services are rendered legally for entertainment purposes only; however, this does not mean that such a company does not have the obligation to present those services advertised.in other words, I was expecting a personal psychic reading, and neiher the generalized nonsense I received, nor the recipies.

I highly encourage anyone with access to a computer or similar research mechanisms to do their homework BEFORE doing business with any such company.
