Ripoff fraud dishonest illegal

Basically, we contracted to have a move from CA to AZ. Contract stated our car to be in the moivng van. Owner of moving company said that he was getting a smaller truck and would have one of his flunkies drive our car to AZ. Being unacceptabale, we mutually agreed not to do this move and he said he would refund our (prepaid, by his demand) money for this move. Refund would be processed and would take a few weeks.

Later, he informed us that there is a no refund policy at all (the contract did not state this anywhere - front or back).

After that we contacted another mover and he said that there is no such policy as no refund.
We feel that this is a rip off and that it was preplanned by this company since two other moving companies estimated the weight of our belongings to be in the 6000 pound range. This company said that our belings - including the car - would be 6000 pounds. Our car is approximately 3700 pounds. We feel that he underestimated on purpose so that the contract would be cancelled and he would then get our $3940.00 for doing nothing.

The PUC said that this company is not licensed nor insured for moving.

If this isn't fraud, I don't know what is. I understand that we can take him to small claims court and when we win the case (and we should) what are the chances of recouping the money?
