DMS, CIT ripoff

Back in 2002 I opened my business and looked for the option of credit card payments. DMS was the choice for using the credit cards. I leased a machine from one of their partners and the billing from Ipayment Inc. Before signing the lease I've contacted DMS and asked about monthly fees and DMS representative mislead me to believe the fees could be waived every month even if no usage. I advised him many times that I'd only sign the contract based on his information and Tony told me that I could cancel the account at any moment I wanted leading me to believe that I would take no risk since I could cancel altogether any time I wanted.

After our phone conversation when I made myself clear that I didn't want to sign. Assured by Tony many I signed the contract and faxed back to DMS. A month later I've received the invoice showing $25.00 monthly fee and $10.00 statement fee. Contacted Ipayment on 11/12 and learned I was mislead to sign an "Iron Clad" contract and no options to cancel it. On that evening I've tried to solve my problem since Ipayment bounced me back to DMS that bounced me to CIT Lease Group and I was informed clearly that I've signed such type of contract and I couldn't break it at all. On 11/18 DMS faxed request for me to fax information to 1-805-495-2354 for refund/cancel my merchant account. Now that I've been paying for the credit card machine for almost 3 years I would like to express my disatisfaction, reverse my situation and request your intervention to prevent other inocent people to be trapped into the same situation.
