Ripoff cashed our check but never sent the shoes we ordered

I sent a check to J.D. Marvel on 01/08/02 for two pair of velcro boots. The check was cashed on 01/16/02, however, I have not reveived the boots. I am trying to decide what recourse we have at this point to either receive the merchandise or a refund.
