Monty Benton No Show, No Refund

I contracted with Monty to DJ my wedding on Oct 10. He came out to the venue, planned where everything would go, and I signed the contract and paid my deposit. The night of the wedding, nobody showed up. Nobody answered the phone. I finally emailed him from my cell phone, and got a reply during the reception. He had gone out of town, and assigned one of his employees to cover, and the employee never showed. That was his story, at least. Since then, despite several emails promising to return my deposit, I've never gotten it back. He always promises to meet with me a few days later, then never shows.
