Trying to foreclose on my timeshare when all payments were made without notification to us

Diamond Resorts is trying to take our 3 bedroom timeshare and put it into foreclosure. We are appalled and very distressed. We do not know where to turn and are hoping someone out there can direct us to someone who can help us.

We have paid all of our fees, which incidently have increased by 40% since the inception of Diamond Resorts buying Sunterra. On April 29th, we were sent back the final check for 100.00. The resort claimed we owed 586.00 in fees. We explained that all fees had been paid, and did not know why they sent back our final check.

I called my bank and they faxed over 16 cancelled checks that were cashed by Diamond Resorts. These checks dated back to the previous years fees as well. Diamond Resorts said that they never received the fax. I had my bank re-fax my checks. At that point, the resort said they received the checks, but that my unit was sent to a lawyers office for foreclosure.

I bought this timeshare and paid in full 10 years ago. Diamond Resorts was not involved in that transaction. I have never had ANY issues until Diamond Resorts bought our unit. This is ILLEGAL. I have tried to contact the "lawyers office" but to no avail. I was able to speak to a woman at the law firm, who I also had my bank fax all of the cancelled checks to. She did recieve the fax, but stated that my unit was just in the beginning of the forclosure process. HOW can they get away with this? I have left numerous voice messages and numerous e-mails have been sent. This has been for 1 1/2 months. I finally reached her yesterday 07/19 and she transfered my call to the "lawyer handling my foreclosure" which was sent directly to his voicemail. I have left 2 messages for him, but have not had a return call. I have also e-mailed him, but have not had a response.

I have been reading a lot about this foreclosure scam from Diamond Resorts. We have written the Attorney Generals office with no help. Also, I have written to Consumer Affairs. I will go public, Call Good Morning America if I have to with this absolute Atrocity!!! If there is anyone out there that can help us, please e-mail asap. Thank you.
