Wrongfully taking my children out of their home and failing to acknowlege my rights, Carson City

9/22/04-My 5 year old stepson goes to school with a black eye that he reports his brother gave him. Talked to 7 year old brother about it and he agrees that they were wrestling around and his brother accidently hit the bed.

9/23/04-CPS shows up at my house with two police officers to investigate my stepson's injury and also searches all the other children for bruises or other injuries. They leave to question the other children who are still in school. Later that night, Mary Lou Rader comes back and states that a medical exam needs to be done on the 5 year old. While at the hospital Mary Lou refused to release him to his father stating that he was not safe at home. Their biological mother gets called and she takes the 3 children that are her's and my husbands.

9/27/04-We call Mary Lou because we wanted to know what was going on. We had read in the pamphlet they gave us that if the children get taken then we have a right to a protective custody hearing within 72 hours. She informs us that since my husband signed a service contract allowing them to go to their mother's that we did not have a right to that hearing. She states that they were technically not placed in protective custody. I call her supervisor, Mickey Turner in Carson City and she also concurs with what Mary Lous said and also states that she will be in Yerington the next day. Mary Lou comes by our house later to speak with us about our case. During this conversation, Mary Lou stated that if it was up to her we would never see our children again, she also stated that maybe we should have never had 5 children.

9/28/04-Mary Lou and Mickey come to our house to talk to us because it turns out that all the children were supposed to leave the home. We sign a new service contract including that my two son's have to go to my father's house. Also on this day we go to the police station so they can question my two boys. They said they would question me later.

During the next few days I search online to find out what my rights are. I come across a site that informs me that I have a right to a copy of my CPS file under the Freedom of Information Act and the Privacy Act of 1974.

10/4/04-Called and left a message for Mary Lou to call me back.

10/7/04-Finally get a hold of Mary Lou and tell her that I would like a copy of my CPS file. She says that I am not allowed to see it. I inform her of the Freedom of Information Act and the Privacy Act of 1974, yet she still refuses. She states that I have to have an attorney subpoena them. I call the Carson City office and talk to Mickey Turner, she also states that I am not allowed a copy. I have read through the two acts several times and I still do not understand why they are refusing me. From what I have read, I have every right to a copy of that file. I wonder if they have something to hide and that's why they refuse to give me a copy.

I am now in the process of trying to find an affordable attorney to fight these people for my children. My stepson's injuries were accidental and I see no reason why they were taken out of my home. Every parent knows that kids get into fights sometimes and wrestle around, there's nothing you can really do to stop them from doing this. CPS states that we failed to protect our children and that we are guilty of child neglect. I would just like to warn all parents out there, if your children accidently hurt another one, better keep him at home or you may be going through what I am.
