1) The £891 witheld is presumably for work done or to be done? This was not the case in both instances. I have email proof from new tenants and photographic evidence taken after new tenants moved in to prove this.

2) When Kingfisher Inventories inspected the property on the day I left, they had not been given Smart Inventories photographic inventory, there by having no comparisson. This is not fair adjudication, as the property was not in the best state when I moved in (please check on SMART inventory photos).

3) They refused to have a site meeting with me.

4) I have travelled from Surrey to Brighton to collect evidence from my old property 3 times which is a total of 6 hours diesel expense.

5) I have spent a good 42 hours writing emails, taking photos, collating, sorting and preparing a chronology, over the course of at least 6 days.

6) I lived in the property for a year and a half with 3 children. I consider the only damage to the property slight fraying, which is at the door entrance and exits. This surely would count as fair wear and tear for 4 persons over 1 and half years. Could you also take in to consideration that the carpets were loosly fitted at the beginning of my tenancy anyway.

7) If I had damaged the property further which I didn't I would understand the Landlord needing to keep the money (I have been a homeowner for 4 years and my sister is a LAndlady so I understand). But I actually improved the quality of the property, by adding security with a side gate, leaving rose bushes in the garden that cost good money, leaving a shower rail for the new tenants and clearing buckets of broken glass from the garden at the beginning of the property that the Landlord did not do, even though it is written and said that he did.

On all these grounds and the amount of evidence showing improper business conduct, please can you return the rest of my deposit £891. I have kept copies for myself and submitted a complaints form with the same evidence to the property ombudsman, to hopefully prevent this type of improper business conduct in the future for future tenants and to get some compensation for my time and resources spent in appealing.
