Failure to complete contract agreement

Wayne Fuller signed a contract on 12 July to complete a concrete job on 13 July. Wayne Fuller received an advance payment on 12 July. Wayne Fuller failed to appear on 13 July to perform the contracted job. Wayne Fuller further failed to answer any telephone calls to his mobile phone on 13 July. On 17 July, Wayne Fuller called to advise that he was out of town due to person having a heart attack and would return in 2 weeks, that he planned to do the job. To date, no further communications have been received from Wayne Fuller and he does not answer his telephone.
