Our house was in foreclosure. Due to many financial difficulties we were talked into giving our “so called” best friend an opportunity to help us legally in setting up a land trust for us.
He is not a practicing attorney but a paralegal student at Everest University who agreed to do this for us.
We quit claimed the house to him for 10.00 no money was exchanged on June 28th. Our verbal agreement was clearly spelled out or so I thought.
The Original Agreement:
Mr. Tony Baird would hold the home for us as a trustee only, for a period of one year from the date of the Quit Claim dated June 28th, to June 28th. And at that time upon completion of the trust papers being written and ready for the trust filing of the house would then be turned over by Mr. Baird to the trust making the owners the trustee’s on the property.
This never happened. Also, on this property the home was being rented out. Mr. Baird chose not only to not perform the service he agreed to, he decided to not return the house. He then sent a letter to our Renter’s Home then proceeded to make a visit and told the renters he was the new owner and they would have to pay him rent and no longer to us. He literally stole our property and our renters for his own ill-gotten gain. We do not currently have 5,000.00 to hire a lawyer on retainer and another 400.00 to start a legal suit against him because he has stopped all of our rental income from May to now present.
We did everything in our power to work out this situation with him. We made visits to his Home he wouldn’t open the door. We texted him, we emailed him and even contacted one of his professor’s at the university to act as a third party of which the professor agreed to do. However, Mr. Baird refused to engage in any type of action.
We are now out of 4 months of rent, with no service rendered of any kind, and no more home.
