The text message I received states, "Winning #76966. You have won the $1000 Best Buy Card! Redeem your prize here www.tinyurl.com/882932." Note that this message does not use the terms "you are eligible to win", you "may" have won, or anything like that. It states "You have won" the $1000 Best Buy Card. I believe this makes it an actionable offense.
