Early Cancellation Fees

Terminated Dish Network after months of no to very poor reception, DVR failed to work, etc below is my response to their damn for Cancellation fees: Per your recent correspondence in which you state “Dish will automatically debit your bank account or charge your debit/credit card for the Dish cancellation fees on 03/07 if you do not restart your account.” Per “As a subscriber of Dish and/or Wild Blue, you signed contract (s) with promotional agreements and you chose term conditions for a certain number of months. You further agreed that if you terminated your Dish and/or Wild Blue before the terms you chose ended, that you would pay early cancellation fees comprised of the prorated amount set forth in your contract (s) multiplied by the number of months remaining in your term commitments.” I agree that I did indeed enter into this contract with the following understanding:

1. Dish programming would be available to me at my home 24/7
2. I would receive a viewable signal at least 85% of the time
3. I would have a fully functional DVR

This was and has not been the case on any account. The total uptime for this service has been at best 45%, the DVR has never functioned properly. I have made multiple calls to your abysmal Customer Support and wasted countless hours with your even poorer Technical Support. I have rebooted the receiver literally hundreds of times; I have cut down trees in an attempt you get this piece of rubbish you call a service to work properly. I tried increasing and decreasing the programing in a vain hope that this would somehow improve the signal to at least a viewable strength. Your abysmal customer support actually expected me to pay to have YOUR equipment checked.in the end I had enough of beating a dead horse and indeed did terminate my service.
Dish Network violated the contract by NOT providing the service promised. At the very best, this is a push, and truth be told, Dish Network should provide me with a refund for payment made to a non-functioning service.
