Ripoff Deceptive Trade Practice Fraudulent Misrepresentation Houston Texas

My husband and I are Senior Citizens. We purchased a newly constructed Model Home in 1998. We asked to have the house inspected, and the Brighton Homes Sales Representative gave us a signed, dated 'Letter of Assurance' prior to purchase, stating all inspections had been done by City, County, etc. We have since found there were no County or City inspections ever done on any houses outside of City Limits.

Brighton Homes and the Post Tension supply Co. Cannot produce any soil samples, engineered plans, site preparation plans, and no inspections on our Post Tension Foundation. Our Engineers have labeled our foundation as: "economically uncorrectible, extremely non uniform, below typical industry standard, (Uniform Building Code) and no known way to repair." Our County Appraisal District has lowered the value of our home over $50,000 and would have taken it off the tax roll, had we not been living in it. The house is experiencing alot of differential settlement because of the Houston Gumbo, as the soil is labeled.

We will be in District Court this December, over 5 years since we filed this litigation. Such a shame some builders cannot be honest, follow Uniform Building Codes, rules and regulations, and knowingly cover up structural defects, which we have to disclose should we or our heirs attempt to sell the property. This litigation has taken much of our savings and still is a huge stress on us.
