Took my Money & Did not Start Jo

10/01 I signed a contract with Roland painting and construction to replace some of my rotten siding and repaint the exterior of the house. The total cost was $2800 start date 10/10, and Mr. Roland asked for $800 up front, so I wrote him a check. He told me he'll have someone come over to my house on Thursday 10/06 to leave some materials and power-wash my house so it'll have the whole weekend to dry. Thursday no one came and he did not call me until Sunday 10/09 at 11:35, to tell me that he got called for jury duty and he will not make it on Monday (Columbus day a holiday court house was not open), but he'll have someone at my house on Tuesday to power-wash and leave some materials.

Tuesday 10/11 came and no one came out to my house. I called him at 5:45 pm and he did not answer, I told my sister to call him and he did not answer either, but a few minutes later he returned my sister's call but not mine. I waited until 6:30 and called him back, he did not once apologize for not showing up, he pretended like nothing had happened. So I asked for my money back and he told me that I am breaching a contract. I told him that he told me that he'll have someone at my house on Thursday and no one came, and he said "that was just a promise, if you read your contract the start date is 10/10."I replied "yes the start date is 10/10 and what day is it today? The end of the day 10/11 so you tell me who is breaching a contract when you haven't started your job yet." He reply "would it make you feel better if I sent someone out there tomorrow morning to leave some materials?" I told him that is not the point, if it started bad it will surely end up very bad, so all I want is my money back.

After going back and forth for about 10 min, he said he'll send me my check. Its been 6 days and I still haven't gotten my money yet.
