On August 17, the fuel line of my automobile was torn when my husband accidently ran over a rough curb on edge of a parking lot driveway. When we arrived at driveway of our house under renovation (about 2 miles from incident), we became aware that there was a gas leak. Seeing the lights still on at the convenience store (3 doors from driveway of house under renovation), I drove there to ask the clerk for the number police dispatch (I figured a policeman would know the best way to handle a possible hazzard). A policeman and a fire truck soon arrived. The firemen determined that the leak was not a punctured gas tank (which they could have plugged enough for the car to be driven to a repair shop). Since the damage was a torn fuel line, the firemen said we would need to have the car towed to a repair shop "of our choosing".

The policeman called the tow service who was "next on his list" which happened to be David Daniels (American Towing). Before the car was loaded onto the truckbed, my husband told Mr Daniels and Officer Buggs that we needed to use our AAA Insurance and Mr Daniels proceded to load the car and we called AAA to let them know. When AAA asked for the Tow Service ID number, Mr Daniels said that he had been dropped by AAA a few months ago. Since the car was already on the truck bed, we then asked the AAA representative if AAA would waive the fact that Mr Daniels was no longer on their approved list and allow this tow... To which AAA agreed (at the commercial rate). Mr Daniels was not satisfied with the commercial rate and (instead of just simply putting my car down) drove back to his place of business and locked my car in the impound lot.

By the time Mr Daniels drove off with my car, Police Officar Buggs had already left the scene. I called police dispatch and requested his return. Another officer was sent. (I beleive he was Leutenant Spedale). When I asked him to stop Mr Daniels from taking my car, he told me that this was a "civil matter".

At no time was Mr Daniels given permission to take my car to his place of business. Mr Daniels knew, full well, that I wanted my car towed to Glenn's Auto Repair (where cars are repaired during nightime hours). A good samaritan, Eric Silivant (who suggested Glenn's Auto Repair and saw all of this transpire), drove my husband and me to Mr Daniels place of business where an AAA approved tow service picked up my car and towed it to Glenn's Auto Repair. However, (with all the delay caused by Mr Daniels) by the time we got to Glenn's, he could not wait for us and had to begin working on another car. The AAA tow service then (with my permission) took my car to Precision Auto Service on Andrews Avenue, where it was repaired by 3:30 pm on August 18.
In order to get Mr Daniels to release my car from his impound lot, I was "forced" to pay the amount of $192.50 and to sign a release form. Because I had no cash and all my credit cards are pretty well maxed out, I had to divide the payment between 2 credit cards: $150.00 on ASA Visa and $42.50 on Chase Mastercard.

Within a few days, I put these amounts into dispute with the respective Creditors. Mr Daniels sent the "signed" release form to ASA and they had to drop my dispute.

I am now asking the court to consider that Mr Daniels did not have my permission to take my car to his place of business and that I was "forced" to use my credit cards and to sign the release form and I am also asking that the court grant me full reimbursement of funds collected by Mr Daniels.
