I was looking on craigslist and seen a seller that would take payments with a 1300 down payment. Met the seller and gave him the 1300 and we both wrote out a contract and signed it. Mine talked about me giving him the 1300 down and the payment plan we had set up until car was fully paid. His said, that he recieved the money but also that in a case of a return of vehicle, any damages would lead to money being non refundable. So we both signed but contracts were never notarized. Exactly two weeks later, he calls and says he skipped. A. Payment and that the car would be towed. I was unaware the banked owned the car. His plan was for me to give him back the car so he could sell it at full price and the give me back my down payment. Stupidly I did but not before. Making a new contract which stated me giving back the car and him oweing me $1300 within 2 weeks. I also two witnesses there and one of them signed the contract as well (contract was not notarized either).
