Dealer Confiscated Deposit

I made a deposit of $500 for a car. I live in Boston and dealer is in NJ. I went home after leaving the deposit and waited for the dealer to get the car ready for pick up. They called me and I drove 5 hours to see that the car was not going to be ready another 2 days. I went home and waited for them to deliver the car as they promised. However, they did not deliver the car because they did not own the car, or have the title for it. I told them I was going to buy it when they have the title. Later they sold the car to somebody else, and they said I have to buy a different car if I did not want to lose my deposit. I have been trying to get my deposit back but they are not even answering my e-mails or phones. They also told my credit card company that the deposit is non-refundable no matter what. Even if they did not have the car that they advertised or increased the price as much as they like.
