Refusing to refund on excess tiles sold

Ken sold us two cartons too many of ceramic floor tiles, although he claims to be in the business for 26 years and can't calculate the correct amt. Of tiles needed to complete a job. He also said, many times that if we had too many, we could return them, better to have more than not enough. He never said, they had to be returned within 30 days. We paid $ 800. It amounts to two complete cartons and a few additional 13 x13 tiles left over more than $100 over what we really needed. He refused to give us a refund on only one carton that we tried to return, since the other one had been opened.
