Buyer Protection Plan is utterly useless

Ebay make a great deal of noise about their "EBay Buyer Protection". However, it is utterly useless.
I received defective goods, which I returned with a tracking ID. However, the seller refused to give me a full refund, but instead charged me a "processing fee".
I disputed this with Ebay to absolutely no avail. The goods were plainly not as described: They didn't work!
Ebay's "Buyer Protection" plan involved them sending us both an email saying we had 3 days to sort if out. To whit: " Thank you for letting us know you had a problem with an item. We are giving both parties three days to settle the matter amicably. We will step in and decide if the issue is not resolved by both parties."
What on earth was the point in that? The seller, of course, just continued to sit on my money.
Then, a week later, I received this:
"We have decided to close this case. You weren't issued a refund and no further action is required."
So, I ask, what on earth is the point in Ebay, and what on earth is the point of a "Buyer Protection Plan" which asks you to "settle it amicably" and then simply ignores the case when the crook with the money keeps it?
I see various others here have alleged complicit fraud on Ebay's part. Yes, they are accomplices to fraud and guilty of misleading advertising. It's a bit like putting the words "Low Fat" on a candy bar
It has to be time for an Ebay competitor - one in which we, the buyers, are not expected to trust the seller but instead pay for the goods after we receive them (or where there is at least an escrow arrangement)
