Violation of the privacy act, lawsuit for midland funding

We opened an account with Sears (citibanK) to buy a new washer and dryer in This equiptment cost $2800, I paid $1000 back the the store at the time of purchase. The agreement of the card was no payments and no intrest for one year. We made 4 payments in the first 4 months, the balance of the card was $1,100, I then used the card to buy one tank of gas ($20.00) it then reverted all payments and all intrest of 69.9%. I recieved a bill of $3,500, I called Sears told them I would pay the $1,100, they then told me that the dept had been turned over to Midland Funding. I contacted Midland, they told me that the dept had been turned over to LOVE, NIXON AND BEAL. I tried contacting them, they would not talk to me unless I would pay them $3790.00 plus $1,200 in fees. They have made several harrassing phone calls from times such as 8pm thru 11pm. I later had my credit run by my bank and LOVE NIXON and BEAL showed up on my credit report, I then went to talk to my Attroney he stated that what they had done had broken the privacy act.

I recieved notice July 29 at 8:30pm by our county sheriff that I had 35 days to responed or I would be sued. I would like to know if anyone else has had this privacy act violation, so I can take futher action..

I would still pay the balance I owe, but not 3790.00 at 69.9% intrest
