Bad business practices by not honoring agreements

Seeing that the sound of our film needed to be mixed, we found Kip Kaplan and Audioworks Producers Group and enlisted them for the job. He requested a large amount of money to do the job, money we didn't have. So, he made an agreement with us. He would do the job for a small deposit of the set price and the rest would be owed to him as a deferment only if we get distribution. The agreement, however, stated that they (Audioworks) would do everything in their power to improve the sound, which included as much ADR we needed for certain scenes, etc.

The mix Audioworks gave us was terrible. It was probably the only complaint other seasoned professionals had against our little film. Such complaints prompted us to contact Kip for another mix of the film's sound.

Kip's underling recorded some ADR for us but, after months of stalling us, he walked away from our project, complaining that he can't continue on it for free despite the agreement we had with Kip. He had his chest out, saying, "I don't work for Kip."

There was a small part of me that was relieved when the underling walked away. His negligence was costly to our film.

Then, Kip contradicts the underling's claim, making it clear that the underling was employed by him and he'll be back on the project in due time.in other words, "I own him." I didn't want the underling back on the project but I didn't argue much on it either. I just wanted the work done. After hearing nothing from this guy, I waited another week or two only (almost six months after my initial complaint about the mix) to have Kip walk away from the project. Kip stated in his email:

"We feel we have performed under the contract we signed, above and beyond what was called for. Your need to revise the mix of your movie is your prerogative."

Wow.

So, Kip took his small change and ran. No wonder nobody ever heard of them in the film community. He's limited to recording Foreign Languages for the DVD's of unknown films from outside the U.S., filmmakers who aren't around to keep a close eye on him, and completely unknown animated films from countries you never heard of. Now he would want his deferred pay "if" we get distribution?

Consider yourself warned: Kip Kaplan of Audioworks Producers Group is a money grubbing amateur who can't mix a bowl of cake mix, let alone an entire film.
