Contract bait and switch scam! Lies and tricks to get you to sign!

The saleman, Frank Firetti, met with me and promised me the best pool at the best price with all the bells and whistles. He also wanted to list the electrical and deck work on an appurtenance agreement. He said those items did not have a markup on the cost and he had to list them separate so that he would not have to pay royalties to corporate. I believed him and I signed the contract on May 21st 2009 and the next day he calls back and tells me the owner did not approve the "deal" he had made for me.

Then the owner, Sal Firetti, calls me. During the conversation I told him that we had to wait a couple of years to get this pool because I found out I had cancer shortly after buying this house but now I am cancer free and eager to get a pool built. After hearing that I am a cancer survivor he lays it on thick about how he always gives to cancer charities and he supports St. Jude Childrens Hospital. He then says that he will pray for me and tells me that he will give me all the items in the contract but he will have to charge me $1000.00 more and I will have to sign a contract addendum. I agreed but told him that I found out that the appurtenance agreement was really a way that released him of all warranty responsibility for the electrical and deck work and that I was not okay with that since he was the contractor I was hiring and he was the one sub contracting the electrical and deck work out the he should be responsible for the work. He agreed and he faxed me the addendum. But the addendum showed several changes that Sal had not even mentioned and I refused to sign it.

Then after more negotiations we finally agreed on a new price but when I started asking more questions then they stopped taking my calls and Sal Firetti, the owner, sent me an e-mail saying he was taking out several thousand dollars worth of equipment like the diving board, heater, LED light, etc. But raising the price by another $500!! I guess he figured I was desperate to get this pool because only a desperate fool would agree to this! And he wasn't even professional enough to call me he just sent an e-mail with a take it or leave it attitude. I want people to be very careful about signing any contract. Never take anyone's word if the contract doesn't spell it out. Never sign an appurtenance agreement because that means the contractor wont be held responsible for the work and you will have to go after the sub-contractor for repairs and warranty work. Be especially wary of the Blue Haven Pool in Manassas Virginia because they promise you the moon and then hand you a flashlight!!! (but charge extra for batteries!)
