Delgadillo should have dropped his lawsuit

CITY Attorney Rocky Delgadillo has never been particularly conscientious with public money.

After all, this is a man who let his wife drive his city-issued SUV and then stuck taxpayers with the repair bill when she dinged it. (Delgadillo wrote the city a check for $1,200 after he was caught.)

But with less than one month left in office - and with the city in a financial crisis that will result in hundreds of layoffs - one would have hoped that Delgadillo would take the high road and drop his lawsuit to prevent the city controller from auditing his workers' compensation program.

He did not.

Instead, termed-out Delgadillo dug in his heels and told a judge last week that he wanted to continue the lawsuit spawned by a turf war with Laura Chick, who left the Controller's Office in May. He wants the taxpayers to foot the bill for a fruitless fight that, even if he wins, will be rendered moot in just weeks. City Attorney-elect Carmen Trutanich has already said he would welcome such an audit by incoming City Controller Wendy Greuel.

The City Attorney's Office justified this disregard for public expenditures by saying that the issue affects all current and future city officeholders, and needs to be resolved by the court. Yet, Delgadillo is the only elected official who seems to have a problem with the possibility of a program audit. Mayor Antonio Villaraigosa welcomed an audit of his gang program.

City Controller-elect Greuel tried to convince the judge to put the lawsuit on hold until she and Trutanich take office on July 1. But because Delgadillo refused, and Trutanich did not want to step on the toes of the current city attorney, the judge proceeded with the case.

So the private attorney for the controller worked through the weekend and arrived to the courthouse Monday with a 2-foot-high stack of documents. City taxpayers will now have to pay for that weekend work. State taxpayers will have to pay for the judge's time to read those filings.

All that money spent on an issue that will disappear on July 1.

The fight began last year when Chick tried to conduct a performance audit on the workers' compensation program managed by the City Attorney's Office, including how the cases are handled and settled. These cases pay out well over $100 million a year and costs have been on the rise.

Yet, Delgadillo blocked Chick, saying the controller had no right to conduct performance audits on other elected officials.

She served his office with a subpoena, and Delgadillo went to court, arguing Chick was overstepping her authority and does not have the power to conduct performance audits on the offices of elected officials.

Now, a judge will decide the issue. Except the changing of political offices has already, essentially, resolved the issue. The only thing that hasn't changed is Delgadillo.
