I recently recieved a summons for a bad debt from a couple of years ago when my husband lost his job. I called the courts around the 17th of Dec. To see if it was a legitimate summons and they told me that my husband already had a judgement against him to garnish the money from his account for the amount of $4,241.00. I was shocked to find this out and told them that I had never been notified. If I had never called we would never had known. They told me we need to file a motion to quash so my husband went down to the courts on the 22nd and filed the motion. On Dec. 26, just four days later my husband went to put gas in his car and our bank card was rejected. I went online to find out what the issue was and my bank account showed a negative balance of over $104,000. Where did this amount come from? The bank didn't have a clue and said they would check into it. The bank obviously put a freeze on our account till the matter is resolved. What was the whole motion to quash for? It obviously didn't help. This is all the money we have. We don't have any money in savings. I'm not sure how we are supposed to pay our bills or pay for any of the other neccessities. We have four children to feed and take care of. I wasn't aware they could go into our account and do this. I know they are trying to force our hand. We don't have the $4,000 and for that matter it is totally over inflated. My husband doesn't want to contact them until he gets some legal advice first. I'm just infuriated that they can get away with this. We were never even summoned about this. I feel that this law firm is filled with nothing but bottom feeders, seeking out the little people who are caught unaware. Not really sure what we are going to do at this point.
