Can unifund collect a debit that has been charged off my account for 5 years?

I have received some alias civil papers that were served to me by the Sheriff for a debit collection from Unifund. I have never heard of this company or received a phone call in regards to this matter. They are trying to collect a debit on a credit card that was open in 10/99 and charged off in 12/03. This debit will be officially off my credit report in 01/09. I have been reading some horrible stories about UNIFUND and I am astound that they have changed their name numerous of time within the past two years. They are trying to make me pay back double what I originally owed on the credit card. Isn't this a statute of limitations since this account is past 5 years old? This company needs to be band from doing business ever again, because all they are doing is ripping people off to collect and take money from people.

I am barely making ends meet and for someone to try and rip me off for something that has been closed for 5 years and will be off my credit report in January I feel that this isn't right at all. Someone needs to get tot he bottom of this and stop this company from collecting real old debit on people. The country is already messed up as it is, and for this company to serve me papers on something that will soon be erased is very unsatisfactory. I looked them up on the BBB of Cincinnati and they have an unsatisfactory record with over 100 complaints that has not yet been resolved from UNIFUND.

I have written a defense on my behalf and I have mailed it to our County Clerk's office to put in my file about this debit. Does anyone have any suggestions on what else I should or need to do? They are doing a lot of falsifying documents, because the papers that I received were dated at the top 5/5/04 and I could tell where they were photocopied because they weren't clear to read. I strongly feel that his company needs to be band from ever doing business again and I think that they should pay everyone that has suffered through pain that they have put us through. I am very upset with this issue and what they are trying to do in regards to this debit that they are trying to collect. I am doing everything in my powers to resolve this. Please someone help me...
