Failure to honor signed contract

I signed a contract with this company to provide quality leads for potential annuity opportunities. I signed this contract on September 18th. This contract states that "Annuity Lead Solutions agrees to furnish 20 appointments for the amount of $750.00 in the name of myself in the State of NJ. Annuity Lead Solutions will deliver 1 appointment per day 2-4 times per week for 6-10 weeks." I paid for this service in full via credit card.

Two months have passed and only two appointments were scheduled. When I visited the homes of the "qualified" leads, in both cases the individual had no idea who I was, where I was from, and no recollection of speaking with anyone at Annuity Lead Solutions. After many attempts to contact someone at the company via e-mail, no one answers the phone, I was told that I needed to warm up to the prospect and not to expect a sale in the 1st five minutes. I am a CFP with 15 years experience so I did not appreciate an appointment setter telling me how to do my job. Plus, these were not "qualified" leads to begin with.

I contacted the owner of the company, Tom Dean and expressed my frustrations. He proceeded to tell me that there other advisors in the area that he works with and that they are very successful and meet with many prospects. I responded that I am not concerned with anyone other than myself and that he has not delivered on the contract tht I had signed. He told me that he was going to look into this situation further and get back to me. He never did. I followed up with a letter requesting a full refund of the $750.00.

Weeks went by when I finally got the owner on the phone. He became angry with me that I have not given enough time and that I want my money back. He told me that I was just another agent and a failure in the business. I told him I did not want to discuss the situation any further and I just wanted my money back because he did not delvier as promised. He told me that I was not going to get the full refund because of the cost that was involved in gathering names. I asked him how much could I expect and he did not have any response and that he would have to look into it. This was over a month ago and I still have not received one penny.
